More on the US and UK transgenocide

The following is from an email I sent to my local federal MP today:

***

I wish to begin this email by quoting from our "Genocide Convention Act" of 1949, which is still in force:

Article II
In the present Convention, genocide means any of the following acts committed with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such:
(a)   Killing members of the group;
(b)   Causing serious bodily or mental harm to members of the group;
(c)   Deliberately inflicting on the group conditions of life calculated to bring about its physical destruction in whole or in part;
...
(e)   Forcibly transferring children of the group to another group.

In the USA and UK, actions have been taken to deny essential medical aid to adult and child trans and gender diverse, including nonbinary, (TGD) people, which comes on top of a long history of murders of TGD people that led to the International Day of Transgender Remembrance. These actions have been so severe that the Lemkin Institute issued a statement on the genocidal nature of what has been happening, and did so LAST YEAR.

We now even have mainstream media in the USA using the term transgenoide - see, for instance, this report on the US ABC News website.
The one correction to that report which I would make is that TGD people and their families have been fleeing the genocidal states within the USA for months - there are, effectively, networks close to underground railways and funding arrangements, much as was used in Europe in the 1930s.

To return to our Genocide Convention Act of 1949:

Article III
The following acts shall be punishable:
(a)   Genocide;
(b)   Conspiracy to commit genocide;
(c)   Direct and public incitement to commit genocide;
(d)   Attempt to commit genocide;
(e)   Complicity in genocide.

Article IV
Persons committing genocide or any of the other acts enumerated in article III shall be punished, whether they are constitutionally responsible rulers, public officials or private individuals.

Article VIII
Any Contracting Party may call upon the competent organs of the United Nations to take such action under the Charter of the United Nations as they consider appropriate for the prevention and suppression of acts of genocide or any of the other acts enumerated in article III.

One of the key actions in saving people from any genocide, is enabling them to flee to safety. Some states in the USA, are accepting trans refugees, and Canada could well become a refuge, however locations in the USA are vulnerable to any future elections of a republican president, and thus are insecure; Canada's location and close relations with the USA may make that location insecure. No nation has offered to deliberately accept TGD refugees from the UK, but Europe may be an option.

Given that, is the Albanese government prepared to instruct DFAT to give favourable consideration to TGD people and their families who are fleeing the transgenocide, on the basis that they are fleeing a likely genocide?

...

If not:
  • why not?
    and
  • what actions is the Albanese government prepared to take on the transgenocide?
I note that any person who has been charged with genocide must be arrested wherever they are found - and I will be urging people affected by these events in the USA nd UK to keep records that can be used in future court cases.

I look forward to your advice in due course, and appreciate that this must be referred to others.
